Terms of service
Last updated: 30 September 2026
These Terms of Use govern access to and use of the website available at omy-world.com and its country versions (the “Site”) and set out the terms and conditions for using the Site.
The Site is published by OMY. All information about the publisher and the hosting provider of the Site is available in the Legal notice.
Access to and use of the Site are subject to the user's acceptance of and compliance with these Terms of Use.
By browsing the Site, the user acknowledges having read these Terms of Use and the Privacy Policy, and accepts them without reservation.
These Terms of Use govern the use of the Site. They do not govern purchases made on the Site, which are subject to the Terms of Sale. In the event of a conflict between the two documents on a matter relating to an order, the Terms of Sale prevail. Sales delivered to the United States and Canada are concluded with Omy Design & Play, Inc. (see the legal notice).
OMY may amend these Terms of Use at any time by publishing a new version on the Site. The applicable version is the one online when the Site is consulted.
1. COPYRIGHT
- The Site is the full and exclusive property of OMY.
- The Site is a work of authorship within the meaning of Articles L.111-1 et seq. of the French Intellectual Property Code and, as such, OMY, as its author, enjoys the protection and rights reserved by law.
- Any full or partial reproduction or representation of all or part of the Site or of the products (colouring pages, home objects, stationery, wearable items, etc.) on any medium is prohibited without OMY's express, written and prior authorisation as author and holder of all intellectual property rights.
- Any breach of this prohibition constitutes infringement that may give rise to civil and criminal liability, and OMY reserves the right to claim compensation for its entire loss.
- Private use of products. The purchase of an OMY product entitles the buyer to strictly personal and private use: colouring, framing, displaying at home, photographing and sharing the result on their personal social networks. This right of private use does not transfer any rights. Any commercial use, reproduction for resale, use in a paid workshop, in premises open to the public or in corporate communications requires OMY's prior written authorisation.
2. TRADEMARKS, SIGNS, TRADE NAMES, COMPANY NAMES AND INTELLECTUAL PROPERTY
- OMY, operator of the Site, owns the rights attached to the trademarks, company names, trade names, signs and other intellectual and/or industrial property rights, whose existence and validity are expressly acknowledged by every user of the Site.
- The mention of other trademarks, company names, trade names or signs, whether registered or not, that may be attached to certain terms or signs used on the Site does not constitute any licence or authorisation to reproduce and/or use them without the express, written and prior authorisation of their owners and/or OMY.
- The absence of a protection and/or ownership notice in no way implies that the trademarks, company names, trade names, signs, terms or signs on the Site are not protected.
- Every user of the Site expressly acknowledges that any product, service or technology described in the documents available and/or on the Site may be subject to other intellectual property rights belonging to OMY or a third party. No right to use such intellectual property rights is granted to users.
3. CUSTOMER ACCOUNT
- Creating a customer account is not required to browse the Site.
- Account creation is reserved for adults with full legal capacity. OMY products are designed for the whole family, but opening an account and placing orders are for adults.
- The user undertakes to provide accurate information and keep it up to date. The user is solely responsible for keeping their login details confidential and for all activity carried out from their account. In the event of unauthorised use, the user informs OMY without delay.
- The user may request deletion of their account at any time via the contact page. Deleting the account does not affect the retention of documents that OMY is legally required to keep, in particular invoices and order forms, under the conditions set out in the Privacy Policy.
- OMY reserves the right to suspend or delete an account in the event of a serious breach of these Terms of Use, after informing the user.
4. USER CONTENT
- The Site may allow users to post content: product reviews, photos, comments.
- By posting content, the user guarantees that they hold the rights to it and that it does not infringe any third-party rights, does not contain any unlawful, defamatory, hateful or indecent statements, and does not show any identifiable person without their consent, in particular a minor.
- The user grants OMY, free of charge and for the duration of publication, the right to reproduce and display this content on the Site and on OMY's social media accounts, with their first name or username.
- OMY reserves the right to refuse or remove any content that breaches paragraph 2, without this constituting a general monitoring obligation.
- Transparency on reviews. Reviews published on the Site come exclusively from customers who have actually purchased the product concerned. Each review is linked to an order verified before publication. OMY does not publish sponsored reviews or reviews obtained in exchange for a benefit, and does not remove any review because it is negative. Only content that breaches paragraph 2 of this article is removed.
5. PROHIBITED BEHAVIOUR
The following are prohibited on the Site in particular: automated or mass extraction of content, any attempt at unauthorised access to systems, introduction of malicious code, any action intended to disrupt the operation or availability of the Site, and use of the Site for competing commercial purposes.
